1. Services

James Duong provides web development and digital solutions including website design, basic SEO setup, and hosting services for small businesses in Australia.

All websites are custom-coded by hand for security and performance. We do not use WordPress or drag-and-drop builders.

2. Payment Terms

Payment terms will be agreed upon in writing before work begins. A deposit may be required before starting development.

Final payment is due upon completion and delivery of the agreed services.

3. Project Timeline

Project timelines are estimates and may vary depending on project complexity and client feedback response times.

Delays caused by late client feedback or content provision may extend the timeline.

4. Client Responsibilities

Clients are responsible for providing:

  • Content, images, and text for the website
  • Timely feedback during the development process
  • Access to existing accounts (hosting, domain, etc.) if needed
  • Clear project requirements and specifications

5. Intellectual Property

Upon final payment, clients own the website content and design. James Duong retains the right to use the project in portfolios and case studies.

Third-party tools, plugins, or frameworks used remain under their respective licenses.

6. Support and Maintenance

Basic support is provided for 30 days after project completion. Ongoing maintenance and support services are available separately.

Hosting and technical support terms are outlined in separate agreements.

7. Limitation of Liability

James Duong's liability is limited to the amount paid for services. We are not liable for indirect damages, lost profits, or business interruption.

Clients are responsible for maintaining backups of their website and data.

8. Cancellation

Either party may cancel the project with written notice. Payment is due for work completed up to the cancellation date.

Deposits are non-refundable once work has commenced.

9. Privacy

We respect client privacy and will not share confidential project information with third parties unless required by law.

Client data is handled in accordance with Australian Privacy Principles.

10. Governing Law

These terms are governed by Australian law. Any disputes will be resolved in the appropriate Australian courts.
